Arbitration
Any controversy or claim arising out of or relating to the User Agreement or our Services (other than claims for non-monetary equitable relief) shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. Without limitation to the other limitations set forth in the User Agreement, in any arbitration proceeding, the tribunal may award only compensatory damages and is not empowered to award punitive or exemplary damages. The arbitration shall be conducted in Frederick County, MD, and judgment on the arbitration award may be entered into any court having jurisdiction thereof. Either you or PropertyRoom.com may seek any equitable relief from a court of competent jurisdiction in Frederick County, MD, necessary to protect the rights or property of you or PropertyRoom.com pending the completion of arbitration. You and PropertyRoom.com hereby submit to the personal jurisdiction of the courts located in Frederick County, MD for purposes of enforcement of an arbitration award or for purposes of any action seeking equitable relief.
